Mueller raises possibility of Trump subpoena

Special Counsel Robert Mueller warned Donald Trump's lawyers that the United States president could be subpoenaed and hauled up in front of a grand jury - without legal representation - if he refused to answer questions in the ongoing Russian Federation collusion investigation, insiders have said.

White House spokesman Sarah Huckabee Sanders said in a statement Wednesday that Flood would be joining the White House staff to "represent the president and the administration against the Russian Federation witch hunt".

The latest upheaval of the president's legal team comes as Trump has adopted an increasingly hostile posture toward the special counsel, whose investigation has expanded into an examination of whether Trump obstructed justice by seeking to shut down the probe.

Flood was always the top choice of White House counsel Don McGahn for the job Cobb was given last summer, according to a person familiar with the hiring decision who described Flood as a "fighter".

Trump's lead personal lawyer, John Dowd, left in March.

Ty Cobb, the White House lawyer handling requests from Mueller, has a security clearance, but he's stepping down at the end of this month, and as his role is to represent the office of the presidency, not Trump personally, he hasn't been directly involved in discussions with Mueller about an interview.

In January, President Trump told reporters he was interested in talking with Mueller under oath, but behind the scenes, the president's lawyers have been carefully negotiating the terms of those possible talks, CBS reported.

John Dowd told Reuters that Mueller mentioned the possibility of a subpoena in the early March meeting.

"We're not having adult supervision in the Justice Department", said McCarthy, who asserts that proper oversight would not allow the subpoena of lesser figures without clear evidence of a crime.

"The idea that the president would be immune from testifying in a serious criminal prosecution is probably a nonstarter", he said. Caputo is a longtime ally of Stone's, a close associate of Trump who has come under scrutiny in the Russian investigation because of Stone's contacts with WikiLeaks during the campaign.

Despite that, Trump wrongly tweeted on Tuesday that none of the leaked questions deal with any alleged "collusion" between his campaign and Russian Federation. For now, the proper framing is this: Trump can testify the easy way (not under oath, with his lawyer) or the hard way (alone in front of a grand jury). For all the Trump supporters who love him because he is a fighter, the Russian Federation investigation has become the kind of flawless foil that fiction writers dream about. On Wednesday Trump himself tweeted that the obstruction investigation is "a setup & trap".

That sets up the prospect of a long legal battle that would run parallel to the sprawling Mueller probe. In this brilliant clip focusing on the Mueller leak, Noah excoriates the POTUS for his illiteracy, compares Trump's lawyers to parents tricking their toddlers, and pauses to nail Sean Hannity for a rather elementary mistake at the 4:00 mark.

In another tweet Thursday, Trump cited comments from attorney Joe diGenova that questions about Comey's firing "are an intrusion into the President's Article 2 powers under the Constitution to fire any Executive Branch Employee...what the President was thinking is an outrageous....as to the President's unfettered power to fire anyone..."

He says: "What are they afraid of?"

"A Rigged System - They don't want to turn over Documents to Congress. Why such unequal 'justice?'" in the same tweet. With everyone focused on whether he would fire Robert Mueller or Rod Rosenstein, Trump took a very different path.

"I think they should understand by now the Department of Justice is not going to be extorted", Rosenstein said.
