VirnetX shares surge as jury says Apple infringed patents

As a result, Apple has been ordered to pay damages to the tune of $502.6 million. VirnetX claimed that features in Apple's FaceTime, VPN on Demand, and iMessage infringes upon these patents.

A federal court in the state of Texas has reportedly asked Apple Inc.to pay almost Dollars 502.6 million to patent troll VirnetX, for the infringement of its four patents associated with secure internet communications. Bloomberg reports that a grand jury found Apple guilty of infringing on patents related to secure communications.

This could be a short-lived victory for VirnetX, however. The case isn't dead yet though, the U.S. legal system has plenty of room for additional appeals and Apple is exploring those options already. The US Court of Appeals for the Federal Circuit in Washington is now reviewing cases in which the Patent Trial and Appeal Board claims the patents in question are in fact invalid.

The company had planned to be producing 20,000 Model 3s a month by December 2017, but in a disappointing Q4 it shipped only 1,542. First-quarter deliveries totalled 29,980 vehicles, of which 11,730 were Model S and 10,070 were Model X.

The dispute has bounced between the district court, patent office and Federal Circuit since 2010.

If this feels familiar, it's because we've been here before, and Apple isn't VirnetX's only target. A recent jury awarded $302M in a case involving older Apple devices; a judge increased that amount to $429.7M. Later on, the company was ordered by the district court to pay more than Dollars 400 million as damages to the patent-holding company VirnetX for copyright violations. The court ruled in the favor of VirnetX and has ordered Apple to pay more than Dollars 500 million as compensation to the patent-assertion organization.
