Former Michigan State University Basketball Players Accused Of Rape

The suit alleges that three unnamed players took the 18-year-old, first-year female home from an East Lansing bar between the evening of April 11, 2015 and the morning of April 12.

The woman, who remains a student at MSU, alleges she was at Harper's Bar when the Spartans' basketball team arrived after midnight. One of the players offered to buy her a drink and asked if she would like to meet "other guys" from the team.

"At the time, the plaintiff was a sports journalism major, so interacting with members of the basketball team was of interest to her", the federal court filing says. She then accepted a ride to the party from two players - the party was at one of their off-campus apartments - and there was no party and her roommate was not there. She was later escorted to a party commencing at an off-campus apartment complex which only contained a few people.

Three ex-players pleaded guilty this past week to lesser charges stemming from a 2017 sexual assault of a woman in an apartment bathroom, according to the Washington Post. She then said she felt drugged and tried to load a song on the laptop which was playing music, but could not manipulate her hands.

The freshman was uncomfortable and was able to exit the bedroom and make her way back to the living room where she felt amusing and suspected she had been drugged.

JD2 then asked the alleged victim if she would like to see some of his basketball memorabilia. At some point she said in the lawsuit that her glass was hard to grasp although she had not had much to drink. While the alleged victim was drinking the water, the lights were turned off and she was thrown face down on the bed and held so she could not move, while JD2 raped her. "At no time did she consent to the sexual activity", the lawsuit states. She took a cab to her residence hall and a later told a friend what happened. She called a taxi and went to her dorm room, "distraught, traumatized, and crying".

The woman reported the rape to a counselor at the university's Counseling Center on April 20, 2015.

"They do have it and they have reviewed it", she said of the lawsuit.

According to the lawsuit, the MSUCC staff made it clear that the woman faced an uphill battle that would create anxiety and unwanted social media attention if she notified the police.

The freshman took that to mean the staff was implying it would be best not to go to police, and was told "if you pursue this, you are going to be swimming with some really big fish", the lawsuit said. The MSUCC staff allegedly did not advise the alleged victim to seek STD or pregnancy testing, physical exam or medical treatment.

According to MSU's policy on relationship violence and sexual misconduct, counselors generally are not permitted to report allegations of rape or relationship violence to the Title IX office or police. They had returned from playing in the NCAA tournament, according to the lawsuit, having lost to Duke University in the Final Four. She later withdrew from the university for the fall 2015 semester and resumed classes in 2016 with a different major.

"Everyone I was in classes with or working with was just all into sports, like 'bleed green, '" she told "Outside the Lines", according to ESPN.

"JD1 pulled Plaintiff into a bedroom and told her 'you are mine for the night, '" court documents allege.

The woman said her roommate didn't know anything about the alleged party and had been looking for the victim but couldn't find her, the lawsuit says.

Karen Truszkowski, an attorney for the plaintiff, said Tuesday that she had no further comment about the suit.
