Court rejects Alfie Evans appeal

Baroness Hale of Richmond said that it was the view of doctors at Alder Hey Children's Hospital, Liverpool, that nearly all of the 23-month-old boy's brain had been destroyed.

The parents of gravely ill toddler Alfie Evans have lost their attempt to persuade the Supreme Court to let them appeal an order that the boy's life support be turned off.

A Supreme Court spokeswoman said: "Having considered submissions from the parties 'on paper", in the usual way, the Supreme Court of the United Kingdom has refused permission for the parents to appeal'.

Christian Concern claims that last week, an air ambulance crew arranged by Alfie's parents was blocked by Alder Hey Hospital from taking Alfie for treatment overseas.

Judges said no detail of the plan could be made public because Alfie was entitled to privacy as his life came to a close. His parents say they have a hospital in Rome, Italy ready to take him to provide appropriate medical care and treatment that the Children's Hospital is denying and possible treatment that could overcome his neurological disorder. He said flying Alfie to a foreign hospital would be wrong and pointless. "Not Alder Hey, not the doctors here not any parents either".

Alfie's parents had relied on a habeas corpus bid to get the court to agree with them that they have the right to withdraw Alfie from the hospital since they are his parents and legal guardians.

They said a person unable to move because of measures taken in a hospital intensive care unit to keep them alive was not being "deprived of liberty".

They lost a first round of cases in the High Court, Court of Appeal, Supreme Court and European Court of Human Rights.

Judges in the case said the hospital must be "free to do what has been determined to be in Alfie's best interests" and there was "no reason for further delay".

However Alfie's father Tom, who this week met with Pope Francis to ask him to intervene, vowed to fight the "cruel bureaucracy".

Francis obliged, holding a minute of silent prayer for 23-month-old Alfie Evans during his weekly general audience and insisting that the only one who can give and take life is God. "We see life and potential in our son and we want to bring him here to Italy, at Bambino Gesú, where we know he is safe and he will not be euthanised".
