Jeff Sessions just tamped down conservative calls for a second special counsel

The Department of Justice inspector general has announced it will investigate the FBI over the use of a FISA court order to spy on a Trump campaign adviser, after the House Republican memo claimed the process was abused.

If Huber finds that there is any need to open an investigation further, that could potentially require a second special counsel investigation, separate to the work of Robert Mueller, who is investigating Russian meddling in the 2016 election.

Sessions' letter was a response to Republican outcry about the FBI's behavior during the 2016 election, including the surveillance of former Trump campaign official Carter Page.

Some Republicans praised Horowitz's latest move, including Senate Judiciary Chairman Chuck Grassley, R-Iowa, who has criticized the process for obtaining secret surveillance warrants and had sought an inspector general review. And the attorney general said he will rely on the prosecutor's review to determine whether or not a special counsel should be appointed.

For months, Sessions has tried to straddle the line between adhering to the high bar set forth in Justice Department regulations for appointing a special counsel in "extraordinary cases" on the one hand - and the persistent demands for one raised by some vocal Republicans, including members of the President's legal team, on the other.

The inspector general's review will also look into what the Federal Bureau of Investigation and Justice Department knew "from an alleged confidential source" as well as their "relationship and communications with the alleged source as they relate" to the surveillance applications.

Democrats have said the investigations are a waste of money and time. Trump's own lawyers called for a second special counsel late a year ago. "While we continue to believe the appointment of a second Special Counsel is necessary, this is a step in the right direction", Goodlatte and Gowdy said in a statement. Attorney General Jeff Sessions said he referred the matter to the inspector general's office.

An FBI agent in Minnesota has been charged over leaking secret documents to The Intercept, reportedly related to threats made by individuals from a particular Middle Eastern country and the FBI's use of informants. Grassley, in a March 15 letter, wrote that if Sessions felt Justice Department regulations did not allow him to appoint a second special counsel, he should instead designate a "disinterested US attorney".
