EU Court Rejects Challenges to Refugee Resettlement

The EU's highest court on Wednesday rejected Hungary and Slovakia's objections to a European-wide migration relocation scheme, laying bare an east-west split among EU member states. Poland backed the Hungarian and Slovak complaint.

"I was convinced that such a decision would be made [by the court], but this absolutely does not change the stance of the Polish government with respect to migration policy", Szydlo told reporters at a business conference.

"Does Hungary really mean it, when authorities say they want to show solidarity?"

Hungarian and Polish leaders, in particular, often describe Muslim refugees as potential security threats.

In related news, Hungarian Prime Minister Viktor Orban's chief of staff, Janos Lazar, said on 31 August that Budapest is asking Brussels for $400 million for expenses related to border protection, which include a fence on its Serbian border finished in April, POLITICO writes. EU Commissioner Dimitris Avramopoulos noted that the judiciary is independent in all EU states in which there is rule of law.

The European Commission warned EU member states earlier this year that there were "no more excuses" for not delivering on promises to take on refugees.

The council was supported in the challenge by Belgium, Germany, Greece, France, Italy, Luxembourg, Sweden and the European Commission.

Some Eastern European countries namely Hungary, Poland, and the Czech Republic refused to take part in the quota system and accept a single refugee fearing social disturbance.

Slovakia is not included in the legal action.

The Czech Republic and Romania have also voiced criticisms of the plan, but only Slovakia and Hungary took legal action.

The ECJ said in its ruling that the European Union "was not required to act unanimously when it adopted the contested decision".

Hungary's foreign minister, Peter Szijjarto, called the court decision "outrageous and irresponsible".

"Solidarity is not a one-way street", he said.

Gabriel added: "We can also expect now, and we do expect, that all European partners will keep to the verdict and implement the decisions without further hesitation".

Foreign Minister Angelino Alfano tweeted "the European Court of Justice upheld our case: the redistribution of asylum seekers is compulsory in the #EU". That entailed closer "relationships with key third countries like Niger and Libya, or simply providing cash to encourage governments to limit flows", she said, referring to funding for programs like job creation and for security measures to keep migrants from attempting the hazardous trip to Europe.

Some 54,000 are now due to be taken from camps in Turkey, which lowers the total figure to be relocated from Greece and Italy.

But the bloc soon faced intense opposition from member states in Central and Eastern Europe that resented any obligation to accept a preset number of migrants arriving in Greece and Italy.

Claude Moraes, chairman of the Civil Liberties Committee dealing with migration, said "we urgently need to have in place an organized and compassionate response" to the plight of refugees.
