Justices could take up high-stakes fight over electoral maps

In the Seventh Circuit decision, the federal appeals court struck down Wisconsin's 2011 State Assembly map as unconstitutional under the First and 14th Amendments. In the 2004 case of of Vieth v. Jubelirer, the court split five different ways and could not agree on a test to determine when gerrymandering crosses a line of excessive partisanship.

The court has wrestled with the question of partisan gerrymandering before but has been unable to reach a conclusion on potential limits to the practice.

Sometimes, modern politicians openly admit that they have create redistricting plans that favor their party, because such gerrymandering has never been ruled unconstitutional by the Supreme Court so those politicians have no reluctance to set their partisan goals and achieve them. Under both, the state maintains, Republicans gained majorities in the legislature in excess of their proportion of the statewide vote. In 2014, the party garnered 52 percent of the vote and 63 state Assembly seats. "Now this story will be told on a national stage".

But the court has not ever ruled on electoral maps that have been re-drawn simply to give a political advantage to one party over another.

The nation's highest court on Monday said it will hear arguments in the case. It essentially measures and compares each party's wasted votes -those going to the victor in excess of what's needed for victory - in an election. The outcome of the Wisconsin case will likely depend on whether Kennedy still believes this.

In last year's report, "The Most Exciting Attack On Partisan Gerrymandering In Over A Decade", ThinkProgress Justice Editor Ian Millhiser wrote, "a dozen years after [Justice] Kennedy despaired for want of a workable way to uncover partisan gerrymanders, two young scholars may have cracked the code". Rather, he preferred to leave the door open to the eventual emergence of judicially manageable decision rules to evaluate such claims.

The federal court that struck down the districts adopted an equation that offers a way to measure the partisan nature of the districts. It acknowledged the efficiency gap, but only as one of several theories the court said corroborated its findings that the Republican leadership had a discriminatory intent, that its plan had a discriminatory effect and that the state had no legitimate reason for drawing the districts in the way it did.
