Here's what could be next for Trump's sanctuary cities order

President Donald Trump is vowing to take his fight to the highest court, calling the decision by a federal judge to block an executive order to withhold funding from so-called sanctuary cities as "ridiculous".

"We'll see them at the Supreme Court", Trump said midmorning Wednesday at an unrelated Interior Department event.

Asked about Orrick's ruling Wednesday, Trump averred that he is "never surprised by the 9th Circuit", reinforcing an early morning tweet in which he declared that it "has a bad record of being overturned (close to 80 percent)". "Once again, a single district judge - this time in San Francisco - has ignored federal immigration law to set a new immigration policy for the entire country".

Trump's words were also cited by federal judges in Maryland and Hawaii, who last month blocked his revised ban on new visas for people from six Muslim-majority countries. "The rest of the order is broader still, addressing all federal funding", Orrick said.

During the campaign, he called Judge Gonzalo Curiel, a sitting federal judge in California who was overseeing a lawsuit against Trump University, a "hater" and a "Mexican", saying his heritage meant he could not impartially oversee the case because of Trump's tough immigration policies.

If Trump is right about the ultimate destination of the sanctuary cities case, he'll face a court reinforced by his own nominee, conservative Justice Neil Gorsuch.

Trump's promise of appeal could land the case in the Ninth Circuit court, viewed as one of the more liberal venues in the federal court system and so a more risky court for the government to lodge a challenge. "Federal funding that bears no meaningful relationship to immigration enforcement can not be threatened merely because a jurisdiction chooses an immigration enforcement strategy of which the President disapproves".
